EU Settlement Scheme Applications

Under the EU Settlement Scheme, EEA citizens who were resident in the UK before 1 January 2021, and who can demonstrate this, had the opportunity to make an application. The general closing date for applications was 30 June 2021, with certain exceptions for specific family members. However, the Home Office may consider late applications only in certain circumstances. Settled status, officially known as Indefinite Leave to Remain (ILR), allows EEA citizens and their qualifying family members to continue living, working, and studying in the UK. To be eligible for ILR, the applicant must have resided in the UK continuously for a period of five years. It is not necessary to have worked in the UK, held comprehensive sickness insurance, or met the requirements of a “qualified person.” Additionally, certain periods of absence from the UK will be discounted.

Although the general closing date for EEA citizens to apply for pre-settled status has passed, there may be acceptance of late applications in specific cases. Qualifying family members may also have the opportunity to make applications. Pre-settled status, also referred to as limited leave to remain, can be converted to ILR after completing a continuous five-year period.

Naturalisation as a British citizen

Individuals with settled status/ILR can apply to naturalize as British citizens after demonstrating 12 months of freedom from immigration restrictions. However, if they are married to a British citizen, they may be eligible for immediate naturalization.
